Key Responsibilities
- IP Landscape Analysis:
- Review IP landscape reports and conduct Freedom-to-Operate (FTO) and non-infringement analyses
- Identify patent risks and opportunities for generic and NCE products
- Patent Strategy:
- Devise non-infringement and invalidation strategies for Paragraph IV (P-IV) filings
- Collaborate with R&D to develop design-around strategies for P-IV and NCE products
- Due Diligence:
- Conduct IP due diligence for product selection and new opportunity identification
- Assess patent portfolios for licensing or acquisition
- Regulatory Support:
- Assist Regulatory Affairs (RA) with patent certifications, PIL clearances, and declarations
- Ensure compliance with 35 U.S.C. § 271(e)
- Litigation Management:
- Monitor and manage ANDA litigations, coordinating with legal teams
- Provide technical insights for patent disputes
- Patent Drafting and Prosecution:
- Conduct patentability searches using databases (e.g., SciFinder, PatBase)
- Draft and file patent applications with USPTO, EPO, or IPO
- Manage patent prosecutions and respond to office actions
- Task Management:
- Plan, prioritize, and execute IP tasks to meet regulatory and project deadlines
- Ensure timely delivery of FTO reports and patent filings
Key Skills
- Expertise in FTO, non-infringement analysis, and P-IV strategies
- Proficiency in patent databases (SciFinder, PatBase, USPTO, Espacenet)
- Knowledge of cGMP, ICH guidelines, and ANDA requirements
- Strong drafting skills for patent applications and responses
- Experience with ANDA litigation and regulatory certifications
- Collaboration with R&D and RA teams for IP integration
- Strategic planning and multitasking under tight deadlines
